General Terms and Conditions (GTC) for Swiss German Lessons
1. Scope
These General Terms and Conditions (GTC) apply to all offers in the area of Swiss German lessons provided by Andrea Holle (hereinafter referred to as the “Provider”). This includes both group and private lessons. By booking a course or lesson, the customer (hereinafter referred to as the “Participant”) agrees to these GTC.
2. Course Places and Execution (Group Lessons)
The Provider sets a minimum and maximum number of participants for each group offer to ensure optimal conditions for the courses. Course places are reserved in the order of binding registrations. A place is confirmed only after full payment has been received. In the case of insufficient participants, the Provider reserves the right to cancel the course. Any course fees already paid will be refunded. Alternatively, a course may be conducted with a reduced number of participants, with the course fee increased or the number of lessons adjusted. Further claims by participants, particularly claims for damages in case of changes or cancellations, are expressly excluded.
3a. Booking and Payment
Private Lessons: The booking of lessons is carried out by the participants via Calendly. Changes or cancellations can be made directly through Calendly and must be made at least 24 hours before the appointment. Lessons are paid for in advance via invoice.
Group Lessons: Registration is binding. By submitting the registration form, participants confirm that they have read and accepted these General Terms and Conditions. After the Provider has accepted the registration, participants will receive a confirmation email together with the invoice. Payment is due within 7 calendar days of the invoice date or, if earlier, before the first lesson of the course. The Provider reserves the right to cancel the registration and offer the course place to another participant if payment is not received by the due date.
3b. Unpaid Invoices
If a participant registers for a group course but fails to pay the invoice and does not respond to payment reminders, the Provider reserves the right to cancel the registration and release the course place.
The Provider may charge an administrative fee of CHF 50 to cover the costs associated with processing the registration, issuing the invoice and reminders, and reserving the course place.
4. Cancellation Policy
Private Lessons: Lessons can be canceled or rescheduled free of charge up to 24 hours before the scheduled appointment. For late cancellations or no-shows, the full amount will be charged.
Group Lessons: Registration for group lessons is binding. Cancellation up to 15 calendar days before the course starts is possible. An administration fee of CHF 50 will be retained (or charged if payment has not yet been made). If cancellation occurs less than 15 calendar days before the course starts, the full course fee is payable.
5. Missed Lessons
Private Lessons: Missed lessons cannot be made up. No refunds will be given.
Group Lessons: Missed lessons cannot be made up. However, all lessons are recorded and made available to participants.
6. Delays
Private Lessons: If participants are late, the lesson will end at the scheduled time without any extension or refund. If the Provider is late, the time will be made up or credited proportionally.
7. Technical Requirements
Lessons are conducted exclusively via Zoom. The meeting link will be provided in advance. Participants are responsible for ensuring a stable internet connection and a functioning device. Technical issues on the part of the participants will not be reimbursed.
8. Liability Disclaimer
The Provider assumes no liability for learning outcomes or for technical disruptions beyond their control. For events, the Provider excludes any liability for damages incurred. Participants are responsible for ensuring adequate insurance coverage.
9. Data Protection
Participants’ personal data is used exclusively for the administration of lessons and will not be shared with third parties. Video or audio recordings during lessons are only permitted with the Provider’s explicit consent.
10. Changes to the GTC
The Provider reserves the right to change these GTC at any time. Participants will be informed of any changes in a timely manner. The version of the GTC in effect at the time of booking shall apply.
11. Jurisdiction and Applicable Law
Swiss law applies. The place of jurisdiction is the Provider’s place of residence.
